Celeb personal trainer's Tribeca studio is too loud: lawsuit

Celebrity fitness trainer Tracy Anderson, who has worked with a number of A-list celebs, has an exercise studio in Manhattan condominium building which is too loud, papers filed in court Tuesday claim.

A celebrity personal trainer who is business partners with actress Gwyneth Paltrow is too damn loud, according to the owners of a condominium building in Tribeca where the trainer operates an exercise studio.

Tracy Anderson, whose clients have included Paltrow, Kim Kardashian, Jennifer Lopez, Kelly Ripa and Lena Dunham, blasts music seven days a week starting at 6 a.m., the owners of 408 Greenwich St. complain in papers filed Tuesday in Manhattan Supreme Court.

“The disturbances are so powerful that they reach all the way from the studio, located on the third floor, to the ninth floor,” the building’s attorney Eric Sherman says in court papers.

The lawsuit says Anderson, who is partners with Paltrow in the studio and an organic food business, has never had a proper city permit to operate her studio since she signed a 10-year lease in 2008 with the loft owner, Shiraz Sanjana, a controversial Brooklyn developer.

Sanjana was briefly barred from selling any condominiums by NYS Attorney General Eric Schneiderman after the AG accused him and his partner of fraud in connection with a Harlem development that they cosponsored.

Court papers say the music used in classes at the Anderson studio accompany her “high intensity choreography” classes that involve “a substantial amount of jumping” and the use of training tools such as poles, hoops and resistance bands.

The resistance bands are draped in colorful loops from the ceiling of the sun drenched loft where people pay $ 900 a month to belong.

The building has a combination of residences and businesses. The ground floor is for retail, the next three floors are for commercial use and the top floors are residential.

The biggest impact has been on one condo owner, Joseph Scarpinito, who owns the loft on the fourth floor directly over TA Studio.

“The noise and vibrations have caused him to completely lose control over his sleep and work schedule,” the papers say. Scarpinito is a musician, songwriter and screenwriter who works from home.

“Scarpinito is regularly forced to leave his apartment to escape the incessant noise and vibrations,” papers say.

The papers say that in 2012, Scarpinito managed to rent his loft for a full year for the upfront price of $ 300,000 but that tenant refused to renew his lease because of the noise and he hasn’t been able to rent or sell it since then for the same reason.

The building hired a noise and vibration expert who said the noise and vibrations on the fourth floor “are more extreme than the average typical noise made by the NYC subway.”

The building owners say Anderson and her landlord have ignored repeated pleas to lower the volume — until September when they announced they were moving. It was quiet for a few months and then the music resumed Monday, they said.

The loft owners are asking the court to order Anderson to be quiet and reimburse Scarpinito more than $ 300,000 for lost revenue and sleep. They also want to be reimbursed for legal fees.
